DISTANCE SALES AGREEMENT

This agreement has been prepared within the framework of the Consumer Protection Law numbered 6502 and the Regulation on Distance Contracts.


ARTICLE 1 — PARTIES

BUYER

The person placing an order through the Barzello website (hereinafter referred to as "Buyer" or "Consumer").


ARTICLE 2 — SUBJECT OF THE AGREEMENT

The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law numbered 6502 and the Regulation on Distance Contracts, concerning the sale and delivery of the product or products with the characteristics specified below, ordered electronically by the Buyer through the Seller's website barzello.com .


ARTICLE 3 — PRODUCT INFORMATION SUBJECT TO THE AGREEMENT

Information regarding the essential characteristics of the product, price, and payment method is shown to the Buyer on the "Cart" and "Checkout" screens before the order is completed.

  • Product information (model, color, size, material) is specified on the order page.
  • Prices are in Turkish Lira (TL) and include VAT.
  • Shipping fee is shown separately in the order summary.

ARTICLE 4 — PAYMENT INFORMATION

  • Payment is made via credit card, debit card, or other supported methods during the order process.
  • Payment is collected when the Buyer confirms the order.
  • All payments are secured with 256-bit SSL encryption.
  • Barzello does not store credit card information.

ARTICLE 5 — DELIVERY INFORMATION

  • The delivery address is the address specified by the Buyer in the order form.
  • The order will be shipped within 2-5 business days after confirmation.
  • Delivery time may take 3-7 business days depending on the shipping company.
  • The cargo tracking number will be notified via SMS and email.
  • Delays in delivery may occur due to force majeure or extraordinary circumstances (natural disaster, strike, etc.).

ARTICLE 6 — RIGHT OF WITHDRAWAL

6.1 Exercising the Right of Withdrawal

The Buyer may exercise their right of withdrawal within 14 (fourteen) days from the date of product delivery, without giving any reason and without paying any penalty clause.

Notification of withdrawal must be sent in writing to: barzello.service@gmail.com .

6.2 Conditions for Exercising the Right of Withdrawal

To exercise the right of withdrawal:

  • The product must be in its original packaging, unused and untried.
  • All labels and original accessories must be complete and intact.
  • Documents delivered with the product (invoice, warranty certificate, etc.) must be returned.

6.3 Exceptions to the Right of Withdrawal

Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised in the following cases:

  • Products prepared in line with the consumer's wishes or personal needs
  • Products whose packaging has been opened and are unsuitable for return due to health or hygiene reasons
  • Products that are mixed with other products after delivery
  • Products that have lost their value as a result of testing or use by the Buyer

6.4 Return Procedure

  1. Withdrawal notification is made via email: barzello.service@gmail.com
  2. Barzello will provide return instructions within 3 business days.
  3. The product is sent by cargo to the address notified by Barzello.
  4. Once the product reaches Barzello, the payment will be refunded within 14 days .
  5. Shipping costs for returns under the right of withdrawal will be covered by Barzello.

ARTICLE 7 — PRODUCT DAMAGE AND DEFICIENCY

  • In case of damage or deficiency detected upon product delivery, the Buyer must notify Barzello with photographic evidence within 48 hours of delivery.
  • Failure to notify implies that the Buyer received the product undamaged.
  • Barzello will provide a free exchange or refund if damage or deficiency is detected.

ARTICLE 8 — CONFIDENTIALITY

The personal data of the Buyer is processed within the scope of the KVKK Disclosure Text and Privacy Policy. 


ARTICLE 9 — RESOLUTION OF DISPUTES

In disputes arising from this agreement:

  • The Consumer may apply to the Consumer Arbitration Committee or Consumer Courts.
  • For Consumer Arbitration Committee applications, one can apply to the District Governorship or Municipality in the Buyer's place of residence.

ARTICLE 10 — EFFECTIVENESS

This agreement enters into force upon the Buyer's completion of the order confirmation. By placing an order, the Buyer is deemed to have read and accepted this agreement.
