INFORMATION ABOUT THE PERSONAL DATA PROTECTION LAW

Dear Customer,

As https://barzello.com/, we would like to provide you with this “Information” letter, which we have prepared in our capacity as the Data Controller in accordance with the Law No. 6698 on the Protection of Personal Data (“LPPD”), within the framework of Article 10 titled “Information Obligation of the Data Controller” and Article 11 titled “Rights of the Relevant Person” of the LPPD; the purposes for which your personal data will be processed, to whom and for what purposes your processed personal data may be transferred, the method and legal reason for collecting your personal data, and your other rights listed in Article 11 of the LPPD:

Purposes of Processing Your Personal Data

Our company may collect personal data in categories such as identity information, contact information, customer information, customer transaction information, transaction security information, legal transaction and compliance information, and marketing and sales information from parties such as customers, employees, potential customers, job candidates, business partners, website and store visitors, and suppliers.

Your personal data collected, whether verbal, written or electronic;

  • To provide you with COMPANY products and services, to fulfill our obligations to you, to organize records and documents, to comply with information storage, reporting, information, tax and other obligations stipulated by local and international legal legislation,
  • To provide you with special advertisements, campaigns, advantages and other benefits for sales and marketing activities to increase the quality of services and products,
  • To communicate with you in order to provide you with the necessary information regarding information processing requirements, system structure, the necessity of the information processing support services received, and these services and products,
  • To increase the quality of service we offer to you and to carry out traffic measurement, statistical analysis, segmentation/profiling and CRM (Customer Relationship Management) studies for sales and marketing activities,
  • Measuring and increasing customer satisfaction, complaint management, receiving your opinions and suggestions regarding new services and products, receiving your problem-error notifications, informing you about products and services, complaints and requests,
  • To manage your membership regarding online sales, to receive your orders, to carry out your payment transactions, to provide logistic cooperation with 3rd parties and to ensure product shipment, to suggest products and services that may interest you, online behavioral advertising and marketing, customer portfolio management, measurement and development of service quality, communication, optimization, audit, risk management and control, promotion, analysis, determination of areas of interest, scoring, profiling, marketing, sales, advertising, communication, comparative product and/or service offer, modeling, current or new product studies and/or developments, to be used in all kinds of products and services to be offered to you within the scope of the law and relevant legislation regulating the works written in the COMPANY's articles of association, which are the subject of your disclosure of your personal data to the COMPANY,
  • To comply with the information storage, reporting and notification obligations stipulated by official institutions, to fulfill the requirements of the contracts and to fulfill the legal obligations to which the COMPANY is subject regarding the use of these services,
  • In line with the purpose of determining and implementing the commercial and business strategies of the COMPANY; managing the financial operations, communication, market research and social responsibility activities, purchasing operations (demand, offer, evaluation, order, budgeting, contract), in-house system and application management operations, legal operations carried out by the COMPANY,
  • It is processed in accordance with the personal data processing conditions and purposes specified in Articles 5 and 6 of Law No. 6698, for the purpose of examining, evaluating and responding to requests from official authorities or you.

Method of Collecting Personal Data

Your personal data may be collected verbally, in writing or electronically through channels such as our Company, our Partners, Group Companies, affiliates, dealers, agencies, solution partners with whom we cooperate or have a contractual relationship, in accordance with the applicable legislation.

Keeping Your Personal Data Accurate and Up-to-Date

Those who share their personal data with our Company accept and declare that they are aware that it is important for this information to be accurate and kept up-to-date, both in terms of the rights they have over their personal data within the meaning of the Law on the Protection of Personal Data No. 6698 and other relevant legislation, and that they will be fully responsible for any responsibilities that may arise in the event of providing incorrect information. Transfer of Your Personal Data to Third Parties

Your personal data may be processed domestically or abroad within the scope of Article 8 and Article 9 of the KVKK in accordance with the purpose or purposes specified in the section titled “Purposes of Processing Your Personal Data” of this Information Text;

– Third parties from whom we receive support in areas such as storage, archiving, information technology support (server, hosting, program, cloud computing, etc.) and security,

– To our subcontractors and service providers who act on behalf of our company within the scope of our business relationship,

– To our group companies that receive support within the scope of our business relationship,

– Business partners, suppliers, financial institutions, consultancy firms that provide support in areas such as law, tax, etc.

– To authorized institutions and organizations to fulfill legal or regulatory obligations or requests and other related parties for whom transfer is necessary for the specified purposes,

– To relevant third parties in a possible merger/acquisition/restructuring process,

– It may be transferred to real or legal persons from whom we receive service and cooperate in the realization of product/service comparison, analysis, evaluation, advertising and the above-mentioned purposes, to program partner institutions and organizations, to institutions with which we have agreements regarding the sending of messages we send to our customers, and to cargo companies that deliver orders placed from our online store to you, within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of Law No. 6698.

Method and Legal Reason for Collecting Personal Data

Your personal data may be shared verbally, in writing or electronically through channels such as our stores, website and mobile application, call centers, social media accounts or other channels that may be established/created in the future;

It is collected by the COMPANY within the framework of legal legislation for the purposes specified above and limited to the existence of legal reasons such as the execution of the contract, being clearly stipulated in the law, your personal data being made public by you, being mandatory for the establishment, use or protection of the right to be granted to you; being mandatory for the COMPANY's legitimate interests and fulfilling its legal obligations in a way that will not harm your fundamental rights and freedoms.

Deletion, Destruction or Anonymization of Your Personal Data

Your personal data processed for the purposes specified in this Information text will be deleted, destroyed or anonymized and will continue to be used by us when the purpose requiring processing is eliminated according to Article 7/f.1 of the KVKK and when the periods determined by the Laws have passed according to Article 138 of the Turkish Penal Code.

Measures Regarding the Protection of Personal Data

The protection of personal data is an important issue for our Company. Our Company takes the necessary measures to protect against unauthorized access to personal data or loss, misuse, disclosure, alteration or destruction of this information.

Our company undertakes to keep your personal data confidential, to take all necessary technical and administrative measures and to show due diligence to ensure confidentiality and security. In the event that personal data is damaged or passed on to third parties as a result of attacks on the website and system, despite the necessary information security measures taken by our company, our company will immediately notify you and the Personal Data Protection Board.

Rights of the Personal Data Owner Listed in Article 11 of Law No. 6698

As personal data owners, if you submit your requests regarding your rights to the COMPANY using the methods set out below, the COMPANY will finalize the request as soon as possible and within thirty days at the latest, depending on the nature of the request. In this context, personal data owners;

  • To learn whether your personal data is being processed,
  • To request information regarding the processing of personal data,
  • To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
  • To know the third parties to whom personal data is transferred, either domestically or abroad,
  • To request correction of personal data if it is processed incompletely or incorrectly and to request notification of the action taken to third parties to whom personal data is transferred,
  • To request the deletion or destruction of personal data in case the reasons requiring processing are eliminated, even though it has been processed in accordance with the provisions of Law No. 6698 and other relevant laws, and to request that the action taken within this scope be notified to third parties to whom personal data has been transferred,
  • To object to a result that is to the detriment of the person himself/herself, as a result of the analysis of the processed data exclusively through automatic systems,
  • In case of damages due to unlawful processing of personal data, the person has the right to demand compensation for the damages.

The COMPANY reserves the right to verify your identity before responding.

In your application;

  1. a) Your name, surname and signature if the application is in writing,
  2. b) For citizens of the Republic of Turkey, your Turkish identity number, if you are a foreigner, your nationality, passport number or ID number if you have one,
  3. c) Your residence or workplace address for notification,

d) Your notification e-mail address, telephone and fax number, if any,

  1. d) It is mandatory to have a request subject and, if applicable, information and documents regarding the subject must be attached to the application.

Depending on the nature of your request, information and documents must be provided to us in a complete and accurate manner. If the requested information and documents are not provided as required, the COMPANY may experience problems in conducting the research to be conducted based on your request in a complete and qualified manner. In this case, the COMPANY declares that it reserves its legal rights. Therefore, your application must be submitted in a complete and accurate manner, including the requested information and documents, depending on the nature of your request.
